摘要 | Read the full PDF. Although the debate over the privacy of personal information continues to escalate, it ignores the practical ramifications of protecting—or failing to protect—privacy. Advocates for both sides often sidestep the economic and technical realities that shape the use of information and the protection of privacy, particularly regarding benefits from information flows to consumer credit and to competition and innovation in the marketplace. The most basic concepts—even the meaning of privacy—lack consensus, clarity, and specificity. Lawmakers must balance the protection of privacy with consumer and societal benefits and the inevitable costs of such protection to individuals, governments, and businesses. Those costs can be significant because of the roles of information in this 21st-century economy—from the consumer market to finance to medical research and health care. “Privacy in Perspective” outlines the complexity of the issues and the stakes in the national debate, sets that debate in practical context, defines key concepts and policy alternatives, and identifies likely ramifications. Fred H. Cate is a visiting scholar at AEI and a professor of law and the Harry T. Ice Faculty Fellow at the Indiana University School of Law-Bloomington. |
