Established to hold trials for crimes committed during the Yugoslav wars in the 1990s, the ICTY has vacillated between its punitive purpose and writing the history of this period. By and large, it has failed to prosecute for crimes committed in Kosovo at the end of the decade. Finally, a string of acquittals led to questions being raised about the very responsibility held by the ICTY. The Court’s ultimate failure thwarts regional
reconciliation in favor of a political course towards European integration.
